COLLECTED INFORMATION PRIVACYPOLICY

John Petschauer Inc. (“JPI”) respects the privacy of the individuals and businesses (“Users”) that access and/or use our website (“Website”). The purpose of this Collected Information Privacy Policy (the “Privacy Policy”) is to inform Users about information that may be gathered about them (“Collected Information”) when they access our Website.

I.          TYPES OF INFORMATION COLLECTED

Collected Information may include a User’s name, contact details, birth date, gender, marital status, financial details, employment details and benefit coverage, including sensitive information such as criminal convictions or health information.

JPI requests that Users provide accurate information that enables JPI to best provide information and services. User hereby consents to JPI’s collection, use, storage and disclosure of Collected Information to appropriate third parties for the purposes described in this Policy.

While Collected Information may come directly from Users, it may also come from JPI’s affiliates or other third parties (such as employers, insurance companies, insurance brokers or agents, credit organizations, motor vehicle and driver licensing authorities, financial institutions, medical professionals, etc.). If Users provide personal information about other individuals (such as employees, dependents, etc.) they must obtain necessary consents prior to disclosure to JPI.

II.        COLLECTING INFORMATION ONLINE

JPI reserves the right to use “cookies” “web beacons” and/or other means to store and track information about use of the Website, which JPI may obtain electronicallythrough Websitesessions. Information gathered through such means may also be used to help improve the Website.

JPI may monitor and collect User’s IP addresses which may be used for various purposes including system administration, trouble shooting and maintenance, and technical diagnostics, and/or in connection with efforts to improve JPI’s information collection efforts.

Users may also engage with JPI through social media websites or through features such as plug-ins or applications on the Website that integrate with social media sites. Users may also choose to link their JPI accounts to third party social media sites. In either case, this may allow JPI ongoing access to the User’s information from a social media account (e.g., name, e-mail address, photo, gender, birthday, the posts or 'likes').

If a User posts information when interacting with our Website through social media sites, plug-ins or other applications, this information may become public on the Internet. Users can control the information they share through privacy settings available on some social media sites. If a User accesses the Website on a mobile device, JPI may collect unique device identifier and mobile device IP address, as well as information about the device's operating system, mobile carrier and location information. When a User provides a mobile device phone number as a contact phone number, the User consents to the use of the mobile device phone number for the purposes identified in this Privacy Policy. If a User chooses to receive JPI notifications on a mobile device (e.g. text notifications) the User also consents to JPI’s use of that mobile phone number.

III.       USE OF COLLECTED INFORMATION.

JPI’s uses of Collected Information include:
• providing information, products and/or services;
• determining eligibility for products and/or services;
• obtaining price quotes for products and/or services;
• processing applications for products and/or services;
• assessing Users’ ongoing needs and offering products and/or services to meet those needs;
• marketing products and/or services.
• executing communication, billing and administrative functions;
• administering claims;
• analyzing data;
• obtaining and updating credit information;
• executing monitoring and training; and
• developing new products and/or services.

IV.       DISCLOSURE OF COLLECTED INFORMATION.

JPI may disclose Collected Information to its business partners and others that are involved in efforts to provide JPI products and services, such as credit and fraud reporting agencies, debt collection agencies, insurers, reinsurers, and managed fund organizations for financial planning, investment products and trustee or custodial services in which Users may invest, insurers, reinsurers, other insurance intermediaries, insurance reference bureaus, medical service providers, loss adjusters, lawyers and accountants and others involved in the claims handling process

JPI does not rent, sell or otherwise disclose Collected Information with unaffiliated third parties for their own marketing use.

JPI may disclose Collected Information (i) if required to do so by law or legal process, (ii) in response to law enforcement authority or other government official requests, (iii) when disclosure is necessary or appropriate to prevent physical harm or financial loss, (iv) in connection with an investigation of suspected or actual illegal activity or (v) in the event that JPI is subject to a merger or acquisition to the new owner of the business. Disclosure may also be required for company audits or to investigate a complaint or security threat.

IV.       SECURITY MEASURES

JPI has implemented reasonable physical, technical and administrative security standards to protect Collected Information from loss, misuse, alteration or destruction. JPI’s service providers and agents are obligated to maintain the confidentiality of Collected Information and may not use the information for any unauthorized purpose.

V.        AMENDMENTS

JPI shall have the absolute discretion and right to change the Privacy Policyat any time and from time to time without prior notice to Users. JPI may do so by posting the changed Privacy Policy on the Website. If a User objects to any change, its only remedy will be to discontinue using the Website. If a User continue to use the Website following any change of the Privacy Policyit will constitute User’s agreement to be bound by the changed Privacy Policy. JPI urges Users to regularly review the Privacy Policy to remain aware of its terms.

VI.       LIMITATION OF LIABILITY

Except as described above, JPI will not intentionally disclose Collected Information to third parties. Moreover, JPI will exercise reasonable efforts to prevent the unintentional disclosure of Collected Information.

JPI WILL NOT BE LIABLE FOR DAMAGES THAT USERS OR ANYONE ELSE MAY SUFFER AS A RESULT OF (A) AN AUTHORIZED INTENTIONAL DISCLOSURE OF COLLECTED INFORMATION OR (B) AN UNINTENTIONAL DISCLOSURE OF COLLECTED INFORMATION IN THE ABSENCE OF INCONTROVERTIBLE EVIDENCE THAT THE DISCLOSURE RESULTED FROM RECKLESS OR GROSSLY NEGLIGENT ACTION BY JPI. IN ALL CASES, JPI’S LIABILITY WILL BE STRICTLY LIMITED TO COMPENSATORY DAMAGES FOR MONETARY INJURIES THAT FLOW DIRECTLY FROM AN UNLAWFUL DISCLOSURE. JPI WILL HAVE NO LIABILITY FOR PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES OF ANY SORT, INCLUDING LOSS OF INCOME OR LOSS OF REPUTATION.

The Website contains hyperlinks to Internet sites of other businesses and resources, each of which may have its own privacy and data collection policies and practices. JPI is not responsible for the privacy and data collection policies and practices of any other businesses and resources, or for the content of their Internet sites. Users interested in the privacy and data collection policies and practices of other businesses and resources may review their policies. JPI makes no representations of any kind about the Internet sites of other businesses and resources, and JPI disclaims all warranties and responsibilities of any kind, including, without limitation, warranties and responsibilities with respect to other businesses’ and resources’ Internet sites, content, privacy and data collection policies and practices, and actions.
