“Petschauer Trademarks” refers to the trademarks “Petschauer” and “Petschauer Insurance” which are owned by Petschauer and any other trademarks which Petschauer may use to identify its Products and/or Services.
“Petschauer Intellectual Property” refers to: (1) the Petschauer Trademarks and (2) any original works (including words and/or pictures) owned by Petschauer that are or may be protected by the United States Copyright laws and/or similar laws that protect such works and (3) the content, presentation and look of the Site And (4) all trademarks, trade names, logos, domain names, and other distinctive brand features displayed on the Site.

“Products” and “Services” refer to the insurance products and other products and services marketed by Petschauer through the Site and elsewhere.

“ThirdParty Sites” refers to websites or content or resources sponsored or provided by persons or entities other than Petschauer or its affiliates, and which may be reached by links in the Petschauer Site.
“User” and/or “you” refers to every person or Entity that visits or otherwise uses the Site for any reason.
“User Data” refers to any and all data in Petschauer’s possession which relates to User whether provided to Petschauer by User or obtained by Petschauer from other sources.

trademarks, trade names, logos, domain names, and other distinctive brand features displayed on the Site, and owns or is the licensee of all legal right, title and interest in and to the materials appearing in the Site (collectively the “Intellectual Property”). Petschauer owns or is the licensee of the Intellectual Property without regard to whether the Intellectual Property is registered or not, or where in the world those Intellectual Property rights may exist.
B. Nothing in these Terms or in the Site gives any User a right to use or own any of the Petschauer Intellectual Property for any purpose whatsoever.
VIII. USER DATA.

C. Governing Law and Lawsuits. These Terms of Use shall be construed and enforced in accordance with New York law, giving no effect to New York choice of law rules.All lawsuits arising from or relating to these Terms or your use of the Site shall be brought in the Federal or State courts in or for Nassau County, New York, USA, and you hereby submit to the exclusive personal jurisdiction of such courts for such purpose.
D. Severability. If any provision of these Terms of Use is found to be void or unenforceable under existing or future law, the remaining provisions of these Terms of Use shall nevertheless be binding with the same force and effect as though the void or unenforceable parts were deleted.
